Terms of Use

The short version
- Your memories stay yours. We only use them to run Laterly for you.
- Only add things you have the right to share, and be kind to the people in them.
- Subscriptions go through the App Store or Google Play. Cancel anytime in your store settings.
- Laterly takes good care of your journal, but please keep your own copies of anything irreplaceable.
1. About these terms
These terms are an agreement between you and Websitters sp. z o.o., ul. Aleksandra Hercena 10, 50-453 Wrocław, Poland, entered in the National Court Register (KRS) under number 0000946109 by the District Court for Wrocław-Fabryczna in Wrocław, VI Commercial Division, NIP (tax ID) PL8992915384, REGON 521002056, share capital PLN 20,000 (“Laterly”, “we”, “us”). They apply to the Laterly app, the guest pages on getlaterly.com and this website (together, “Laterly”). By creating an account or using Laterly, you agree to them. Our Privacy Policy explains how we handle personal data.
2. Who can use Laterly
You must be an adult (18, or the age of majority where you live) to create an account. Laterly is made for parents and the family members they invite. Children don’t use Laterly themselves. Guests who send something through a family event link don’t need an account, but these terms still apply to what they send.
3. Your account
Give accurate information and keep your password safe. You’re responsible for what happens in your account. If you think someone else has access to it, change your password and tell us at [email protected].
4. Your journal and your content
You own what you add
Voice notes, letters, photos, videos and everything else you or your family add (“content”) belong to you, or to whoever created it. We don’t claim ownership of it.
The permission you give us
To run Laterly, we need your permission to store, copy, process and show your content to the people you share it with. You give us that permission, worldwide and free of charge, only for operating, securing and improving Laterly for you. It ends when the content is deleted, apart from the short time it takes to remove it from backups. We don’t use your content for advertising or to train AI models.
Your responsibility
Only add content you have the right to share. If other people appear in it, such as family, friends or other children, make sure sharing it in your private journal is fair to them and allowed by law where you live.
5. Families, roles and guests
- The person who starts a journal is its owner. Owners and co-parents decide who can access the journal and can add, change or delete anything in it.
- Contributors you invite can see the journal and add memories.
- Family event links let guests send a photo, video, voice note or message without an account. Nothing they send is kept until a parent approves it. By sending something, a guest confirms they have the right to share it and allows the family and Laterly to keep it in the journal if it’s approved.
- If you delete your account, journals you own on your own are deleted. Journals shared with a co-parent stay with them.
6. Acceptable use
Please don’t use Laterly to:
- upload anything illegal, including any content that sexualises or exploits children, which we report to the authorities;
- harass, threaten or harm anyone, or share someone’s private content without the right to;
- infringe other people’s copyright or other rights;
- spread malware, probe or break our security, or overload our systems;
- copy, resell or reverse-engineer Laterly, except where the law allows it.
If you break these rules, we may remove content or suspend or close the account involved. Unless the law or safety requires otherwise, we’ll tell you first and give you a chance to respond.
7. Plans and subscriptions
Free and Plus
Laterly has a free plan with limits, for example on the number of memories, family events and children, and a paid plan, Laterly Plus, which removes them. The current limits and prices are shown in the app before you buy.
Buying through the store
Laterly Plus is sold as an auto-renewing subscription through the Apple App Store or Google Play, which handle payment. The price and billing period are shown before you confirm. Payment is charged to your store account when you confirm the purchase, or when a free trial ends.
Free trials
If a free trial is offered, it turns into a paid subscription when it ends unless you cancel at least 24 hours before the end of the trial.
Renewal and cancelling
Your subscription renews automatically for the same period unless you turn off auto-renew at least 24 hours before the end of the current period. You can manage or cancel it at any time in your App Store or Google Play account settings, or from You → Subscription in the app. Cancelling stops the next renewal. You keep Plus until the end of the period you’ve paid for.
Refunds
Refunds are handled by Apple or Google under their policies. Where the law gives you a right to withdraw from a purchase, you can use it through the store.
Price changes
If we change the price of a subscription, the store will tell you in advance and, where required, ask for your agreement before charging the new price.
If your subscription ends
Nothing you’ve kept is deleted when Plus ends. Your journal stays, and you can still open, read and play everything in it. You just can’t add more than the free plan allows until you delete some items or subscribe again.
8. Keeping your journal safe
We work hard to keep Laterly running and your journal safe, with encrypted connections, private storage and regular backups. Still, no online service can promise it will never lose data or always be available. For memories you couldn’t bear to lose, please also keep your own copies. Laterly doesn’t automatically deliver your journal to your child at a set date. You decide when and how to share it.
9. Changes to Laterly and to these terms
Laterly will keep changing. We may add, change or remove features. If we make a change that significantly affects you, such as removing a paid feature, we’ll tell you in advance. If we update these terms, we’ll tell you in the app or by email before the new terms apply. If you don’t agree, you can stop using Laterly and delete your account.
10. Ending your use of Laterly
You can stop using Laterly and delete your account at any time in the app (You → Privacy → Delete account). Deleting your account doesn’t cancel a store subscription, so cancel that in your store settings as well. We may end our service to you for serious or repeated breaches of these terms, or if we have to stop offering Laterly. If we ever shut Laterly down, we’ll give you at least 60 days’ notice and a way to download your journals.
11. Liability
Nothing in these terms limits liability that can’t be limited by law, such as liability for death or personal injury caused by negligence, for fraud, or your statutory rights as a consumer.
Apart from that, Laterly is provided “as is” and “as available”. To the extent the law allows, we aren’t liable for indirect or consequential losses, or for content added by other users or guests. Our total liability to you is limited to the amount you paid us in the 12 months before the claim, or €50 if that is more.
If you live in the European Union, you keep all the consumer protections that the law of your country gives you.
12. Law and disputes
These terms are governed by the laws of Poland. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts there. If something goes wrong, please write to us first at [email protected]. Most things can be put right quickly.
13. Apple App Store terms
If you downloaded Laterly from the Apple App Store, the following also applies:
- These terms are between you and Laterly only, not Apple. Laterly, not Apple, is solely responsible for the app and its content.
- Your licence to use the app is limited to using it on Apple-branded products that you own or control, as allowed by the Usage Rules in the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app, if any. To the maximum extent the law allows, Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are Laterly’s responsibility.
- Laterly, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the app or your use of it infringes their intellectual property rights, Laterly, not Apple, is solely responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Questions, complaints or claims about the app go to us at [email protected] or by post to Websitters sp. z o.o., ul. Aleksandra Hercena 10, 50-453 Wrocław, Poland.
- When using the app you must follow any applicable third-party terms, such as your mobile carrier’s.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple may enforce them against you as a third-party beneficiary.
14. Everything else
If any part of these terms turns out to be unenforceable, the rest still applies. If we don’t enforce a right straight away, we haven’t given it up. You may not transfer your rights under these terms without our agreement. We may transfer ours to a company that takes over Laterly, as long as your rights aren’t reduced.
